This law applies to Vietnamese organizations and individuals, foreign individuals engaged in fishery in islands, archipelago and continental shelf of Vietnam. The Decree No 23/2017/NĐ-CP on 13/03/2017 amended and supplemented with a number of articles of The Decree No 162/2013/NĐ-CP on 12/11/2013 that the law sanctions against administrative violations of commercial fishing activities outside the Vietnam’s maritime boundary. This law comes into force on May 1st, 2017.
Under the Decree No 23/2016/NĐ-CP, a fine of 5-10 million VND will be imposed for submarines and vessels which do not fly flag State when operating in the domestic waters and territorial waters of Vietnam. In case it is allowed by the Government or by agreement between the Government of Vietnam and the Government of the country in which vessel is the flag State.
Being banned using antibiotics in aqua feeds, the Decree 39/2017 / ND-CP on 04/04/2017 about management of animal and aqua feeds takes effect from 20/05/2017. The Decree clearly specifies the principles of processing of animal feed containing antibiotics. Specifically, antibiotics are prohibited using in aqua feeds, only a maximum of 2 antibiotics are permitted using in one animal feed product.
The Decree No. 40/2017 / ND-CP on April 5, 2017is regulated in management of salt production, processing and trading come into force from May 20, 2017. Accordingly, when trading on the market, salt products must guarantee food safety and hygiene followed approval for the declaration of standard conformity and regulation conformity registered with the competent state agency; All products are required to have sufficient packages and labels in accordance with the law on goods labeling and food safety (except industrial salt).
Increasing fines for violations in fisheries activities takes effect from May 20, 2017, Decree No. 41/2017 / ND-CP dated April 5, 2017 amended and supplemented a number of articles of Decree No. 103/2013 / ND-CP on September 12, 2013 providing for the sanctioning of administrative violations in fisheries activities in the direction of increasing the fine level for a number of violations.
